Section 5 (a)(1):  of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were exposed
to:
(a) The hazard of being struck by the rotating superstructure and
counterweight of the hydraulic excavator when the superstructure
is rotating:
Construction Site:   Millwood Water Treatment Plant
4 Station Pl., Millwood, NY
a)  On or about 11/29/91, 12/5 and 6/91, employees exposed to being
struck and crushed by the rotating superstructure and counterweight
of the case model 170B excavator which did not have its swing radius
protected.
Among other methods, feasible and acceptable abatement methods to
correct this hazard are:
1.  To barricade accessible areas within the swing radius of the
rotating superstructure and counter weight of the hydraulic
excavator.
2.  Follow the manufactures recomendations for safe operating
prcedures contained in "Case 170 B Excavator, Operators Manual,
Burl 9-11310".
3.  Follow the Construction Industry Manufacturers Association
(CIMA) recommendations for sale operating procedures contained
in "Safety Manual for users, operators and maintenace personnel-
Hydraulic Excavator".
