Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazard of falling approximately 15 feet to pavement. Location: 94 Demarest Mill Rd., Nanuet, NY: On and before 8/30/94: a) The forks of a Clark fork lift truck were used to raise and lower an employee to and from an elevated motorized scaffold (Tirak model TE401P8001, s/n BS01490 with Motor 312623) exposing the employee to falls up to 15 feet to pavement. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To use a safety platform secured to the lifting carriage and/or forks as stipulated by ANSI B56.1-1975, sections 427 and 513A, American National Standard for Powered Industrial Trucks (lowlift and highlift trucks).
