Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Hazard of falling approximately 31.3 feet to ground. Construction site: 6 Gramatan Ave. Mount Vernon NY 10550 On or before 3/1/95, a) Employees were lifted by a Pride Falcon 600 forklift truck P1491 Approximately 31.3 feet above the ground. employee was standing on a makeshift platform not secured to the forks and not provided with standard guardrail. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To use a safety platform secured to the lifting carriage and/or forks as stipulated by ANSI B56.1-1975, sections 427 and 513A, American National Standard for Powered Industrial Trucks (lowlift and highlift trucks).
