Section 5(a)(1): Of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a fall hazard where the ladder used was not of an adequate height nor was it equipped with handrails. a) Pier I Imports, storage area, Rt. 35, Hazlet, NJ - Employees using an 8' fiberglass stepladder to gain access to storage loft 9'2" above the floor were exposed to a fall hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to use a portable ladder equipped with handrails and working platform at a height equivalent to that of the loft's surface.
