Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The recognized hazard of being caught in or between the point of operation on the Mosley Machine Company #1360 metal shear while performing maintenance work. Among other methods, one feasible and acceptable method to correct this hazard would be to lock-out and tag the equipment during maintenance operations. This condition is alleged to have occurred on or about June 20, 1988.
