Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Shop made Monorails Under hung, clevis type, hand hoist with a plain trolley on a standard I Beam, were not tested and records were not available for inspection to assure compliance with ANSIB 30.11. Employees were exposed to struck by hazards in the following areas: a) #1 Boiler room, North South monorail. b) #2 Boiler room, East West monorail. c) FCCU cattower level #1. d) FCCU cattower level #2. e) FCCU cattower level #3. f) FCCU cattower level #4. g) West end of CO boiler. h) Machine Shop, Maintenance building. i) Electrical Shop, Maintenance building. j) HDH unit compressor pump platform.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Fall from elevation, Struck by: Employees are directed to enter a Dumbwaiter which does not comply with ANSI 17.1 rules: 701.1 e, 702.1, 702.26, 702.3, 704.2, 704.4, 707.3, and 707.5; Employees will enter this Dumbwaiter car approximately 120 feet above ground level to remove gat tower's equipment and employees tool. Among other methods, one feasible and acceptable abatment method to correct this hazard is to perform an inspection as per ANSI 17.2 and abate all finding. This condition is exposing employees to serious injuries and/or death resulting from bone fracture caused by said Dumbwaiter's car rigging failing and free falling a vertical distance with employee in this car, or by equipment in the car free falling and impacting employee with high impulse force.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: 29 CF R 1910.106(i)(3)(ii): Unfired vessels were not operated in accordance with the code for Unfired vessels, Section VIII of ASME Boiler and Pressure Vessel Code - 1968. a) Northeast of F.C.C.U.: Primary Absorber GV18 vessel securing bolts had insulation covering and because of this, securing bolts cannot be inspected for corrosion as required by ASME Section VII Appendix MUA-351. This condition is exposing employees to serious injuries and/or death resulting from burns caused by vessel failure due to fatigue. b) Saturated light end, #2 Debutanizer 28-D-002, 48' O/D, 16' high, 80 psig, 100 degrees Fahrenheit, insulated, major evidence of corrosion at the vessel securing bolts and nuts, flanges at the base of the vessel. This condition is exposing employees to serious injuries and/or death resulting from major fire/explosion, resulting from pressure vessel failure. c) Top of Depropanizer reboiler (28-E-030), 28 PI, metering of vapor pressure of the vessel was defective and not operational. This condition is exposing maintenance men and operator, who where working in the area, to burns resulting from explosions.
