Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) 2/8/90, The hazard of having skin or mucosal membranes coming in contact with blood or body fluids carrying the HBV virus which could result in employees contracting Hepatitis B. Members of the nursing staff and employees in central supply were not offered the opportunity to receive the series of injections containe the Hepatitis B vaccine.
