Section 5(a)(1) of the Occapational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazards of being struck smashed and/or crushed by falling materials:
The employees were required to work in the Black Smith Building at rear
of the shop, which had structural deterioration (metal building
structure has rusted through the two main walls (front & rear) as well
as the roof) that could cause the collapse of the Black Smith work shop.
One feasible and acceptable method among others to correct this hazard
is to remove exposed employees, shore and brace building, reinforce
metal structure or demolish the building to eliminate andy possibility
of collapse.
Another acceptable method is to remove the exposed employees and have
professional engineer or registered architect check building conditions
for corrections of unsafe structure.
