Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling down the hoistway shaft when the material hoist car was not at the landing; struck by the descending car, or caught between the car and shaftway components and/or openings in the gates: a)Material Hoist Second and Third Floor Landings: Provisions had not been made to prevent the hoistway doors and/or gates from opening while the hoist car was not at that level, on or about 5/19/94. b)Ground Floor Level: A hoistway door or gate was not installed to prevent access to the hoistway shaft, on or about 5/19/94. c)Second Floor Level: Hoistway gate had dowels missing creating openings larger than two (2) inches, on or about 5/19/94. d)Third Floor Level: Hoistway gate had openings larger than two (2) inches and was less than sixty-six (66) in height, on or about 5/19/94. e)Crane-Hoist/Material Hoist Car: Approval of design, rated load, periodic inspections and maintenance records were not available, on or about 5/26/94. Among other nethods, one feasible and available method to correct these hazards is the installation of appropriate doors and/or gates at all shaftway floor openings and to provide the type of interlocks that prevent the material hoist car from moving when the doors or gates are open, and so latched that they cannot be opened from the landing side unless the material hoist car is at that landing level. This hoistway-door interlock system is in conformance with American National Standard A10.5-1992, and ANSI/ASME 17.3-1990 and is well known in industrial application.
