SECTION 5(A)(1) OF TEH OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO A FALL HAZARD WHILE WORKING ON A MARKLIFT BRAND SELF-PROPELLED SCISSOR LIFT: A) 10/24/90 OUTSIDE, ALONG THE FACE OF THE BUILDING IN AREA C, EMPLOYEES WERE EXPOSED TO A FALL HAZARD OF APPROXIMATELY 30 ' WHILE THEY WORKED NEAR THE OPEN THE OPEN END OF A MARKLIFT MODEL 1500 SCISSOR LIFT. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD WOULD BE TO INSURE THAT THE OPEN END IS EFFECTIVELY CLOSED AS DESCRIBED IN ANSI 92.6 1979 SECTION 5.
