Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the load being hoisted over people, including the I-beam spreader bar #1801, during the cargo loading and textile cargo sling removal operations on July 29, 1996, involving the OMI 15-ton bridge crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and enforce effective safety and health rules such as the guidelines stipulated by ANSI B30.2.0, Overhead and Gantry Cranes.
