Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of
employment which were free from recognized hazards that
were causing or likely to cause death or serious physical
harm to employees in that employees were exposed to:
Hazard of falling approximately 12 feet to pavement.
At MBI Trailer outside of Shipping and Receiving,
2 Nice-Pak Park, Orangeburg, N.Y.
(a) On or before 5/08/92, employee(s) being elevated by forklift
trucks while standing on unprotected and unsecured wooden
pallets to empty nonhazardous industrial wastes into the
MBI Trailer, NJ licence plate # T909-SA; exposed to falls
up to 12 feet to pavement below.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE
ABATEMENT METHOD TO CORRECT THIS HAZARD IS...
To use a safety platform secured to the lifting carriage
and / or forks as stipulated by ANSI B56.1 -1975, sections
427 and 513A, American National Standard for Powered
Industrial Trucks (lowlift and highlift trucks).
