Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 07/16/91 an employee was exposed to the hazard of falling from the shovel of a Front End Loader. One feasible and acceptable abatement method is to use appropriate lifting devices for hoisting personnel such as Aerial lifting devices that meets the requirements of American National Standards Institute ANSI A92-2-69 Vehicle Mounted Elevating and Rotating Work Platforms.
