Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 4/24/91, employees were exposed to the hazard of being struck by falling loads when a homemade boom - truck or winch - truck was used to hoist steel pipes weighing more than one ton. One feasible and acceptable abatement method is to: Use a crane which is designed for hoisting materials and its lifting capacity can be readily determined by the manufacturers data, or its load limitations can be based on the determinations of a qualified engineer.
