Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
deep lacerations, broken bones and fractures due to being struck by or
jolted when a tractor and trailer is being backed up into the decal shop
where employees are working off scaffolds eight feet high, on or about
August 28, 1991.
Among other methods, one feasible and acceptable abatement method to correc t
this hazard is to install a back-up alarm on the truck or assign a person t o
act as a signal man to provide directional signals to the truck driver whil e
he is backing up.
