Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in that employees were exposed to fall
hazards for elevated work stations while working in the basket of an
aerial
lift that had been reported by employees as being defective. On or about
1/30/93 and 1/31/93, several employees had previously reported to their
supervisor and the job superintendent that the aerial lift basket was
unstable on its boom and would rock from side-to-side. On or about 2/1/93,
an employee suffered a lost time injury while working in the aerial lift
which had been reported as defective.  Several feasible and acceptable
methods to correct this hazard is as follows:
1.    When employees using the equipment report unsafe
conditions, these reports must be followed-up by
someone competent to evaluate the piece of
equipment for safety.
2.    If there is no person(s) on the jobsite competent
to make this determination, then the aerial lift
maintenance personnel must be called in to inspect
the equipment and the lift should be identified as
unsafe by tagging or locking out its controls to
render it inoperable, or by physically removing it
from its place of operation until it can be
evaluated.
OR IN THE ALTERNATIVE
Frequent and regular inspections of the job site, materials and equipment
by a designated competent person were not conducted:
(a)   Exxon Plant - On or about 2/1/93, an employee
suffered a lost time injury while working for a
defective aerial lift which had been previously
reported to management as being defective or
unsafe.
