Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health
Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from
recognized hazards that were causing or likely to cause death or serious
physical harm to
employees, in that employees were exposed to: falling more than four (4)
feet from the forks,
and/or from pallet(s) on the forks, of powered industrial truck(s) while
not situated inside a
properly guarded and secured safety work platform.
(a)Frozen Food Warehouse Freezer - On or about Friday, 3/26/99, employees
were
allowed to ride on the forks, and/or on pallets being lifted by the forks,
of
powered industrial trucks without personal fall protection in order to
reach
surface(s) elevated at least 6.33 - 6.96 feet above the concrete freezer
floor for
the following purposes: (1) to get into the Hercules pedestal-mounted
Elevated
Maintenance Platform, Model KI-460; (2) to retrieve boxes of frozen food
product from storage racks; (3) to get onto elevated pallets in storage
racks before
accessing the maintenance platform, etc.
One feasible and acceptable abatement method to correct this hazard is to
provide a properly
constructed, guarded, and easily accessible work platform, secured to the
forks or mast of a
powered industrial truck, for use whenever employees have to be elevated
more than four (4)
feet above the floor.
