Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being struck by collapsing wall of ice: (a)Employees entered the ice house on April 8, 1996 after the ice makers have run off-shifts and over the weekend through a door in one end of the room. Employees used shovels and other tools to move the ice and are exposed to the hazard of engulfment, being struck by shifting ice, or being crushed against the walls of the unit by ice. Among others methods, feasible and acceptable abatement methods to correct these hazards are: 1) Developing and implementing written safe work practices for routine and non-routine tasks that are required to be performed in the ice house and providing employees with information and training on how to protect themselves from hazards associated with work in the ice house and ensure that the use of safe work practices are enforced; and/or 2) Install an ice rake or other automated system to deliver the ice to the auger which will prevent employees from entering the ice house when hazardous condition exist.
