Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to conditions when working close to the deficient pedestal crane at the Shell Platform "A" when the crane was unable to sustain a load causing death or serious physical harm: (a)Shell Platform "A": The West Seaking #2300/3429 pedestal crane has been operational without correction/repair on the bent lacing at the bottom boom base. Per reference API (American Petroleum Institute) Recommended Practice 2D, Third Edition, June 1, 1995, Appendix C, Commentary on Usage, Inspection, Testing and Maintenance C.4.1.2c #14: Boom should be inspected for bent chord members, missing or broken lacing and cracked welds on critical members. Boom section and connections should be inspected for cracked welds, deformation and corrosion.n
