General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Plantwide; Employees were exposed to falling loads in that preventative maintenance inspections/records were not conducted and maintained on hoists throughout the plant. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop a preventative maintenance program with records in accordance with the manufacturer's recommendations. (1) lifting produce at arms reach rather than close to the body. (2) lifting produce from below knee level. (3) lifting produce from above the shoulders. (4) twisting the body while lifting. (5) bending from the waist rather than bending the knees. (6) lifting heavy products without help. an evaluation of the observed lifts was made using the guideline explained in dhhs (niosh) publication no. 81-122. these guidelines include the impact of epidemiological, biomechanical, physiological and psychopysical criteria expressed in algebraic form. the results of these computations shows that at least 15 of the observed lifts were for loads above the action limit (al) but below the maximum permissible limit (mpl) and at least 6 other lifts were above the mpl. these results indicate that the employee was exposed to a significant hazard of back injury and musculoskeletal disorders.
