Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to severe lacerations and/or death due to the employer's
failure to follow safe
engineering practices for demolition of the bridge:
(a)  Jobsite, Demolition of the Center Span (Span 2);  The Kobelco #909
machine
went onto the center span, beyond the south pier, and began to demolish it
while
the Kobelco #220 machine went partially out onto the center span, beyond
the
north pier, to demolish it.  This practice was in direct conflict with the
PennDot
pre-approved site specific demolition plan and repeated warnings from
PennDot
to move to a safe area.  On or about May 2, 1996, an unplanned collapse
occurred injuring an employee.
