Section 17(a) of the Occupational Safety and Health Act of 1970 and
Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that:
(a) An effective Ergonomics Program was not implemented to reduce
or eliminate the hazards of cumulative trauma disorders throughout
the plant facility.
While ultimate responsibility for correcting the hazard rests with
the employer, feasible and acceptable abatement methods to correct
this hazard include, but are not limited to the following:
(1) Implement fully the medical management program as was required
under sections III.C.3. (a) 5. (a)( and (b) and III.C.3. (a) 5.(d)
of the Cagle's Inc. Ergonomics Agreement (pages 6-8).
(2) Implement fully an ergonomics training and awareness program
as was required under sections III.A. (3) and III.C.3. of the
Cagle's Inc. Ergonomics Agreement (pages 2, 4, and 5).
(3) Implement fully the medical training as was required under
section III.C.3. (a) 5. of the Cagle's Inc. Ergonomics Agreement
(pages 5 and 6).
The Cagle's Inc. was previously cited for a violation of Public Law
91-596 Section 5(a)(1) which was contained in OSHA Inspection
Number 17762766, Citation Number 01, Item Numbers 1 & 2, issued on
8-1-89 and incorporated into the ergonomic settlement agreement
effective from 6-19-90 to 6-19-93.
