Section 5(a)(1) of the Occupational Safety and Health Act of 1970:

On or about 6/10/93, the employer did not furnish employment and
a place of employment which were free from recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees were exposed to the hazard of
Tuberculosis when knowingly or unknowingly transporting infectious
patients.  Approximately 35 employees are covered under this
section.  No protection was provided:
a- Feasible and acceptable methods, among others, to correct
the hazard is to:
1- Document a TB protection program which includes the
following:
- Documentation that the employer has attempted to
identify sources of exposure.  These include high
risk hazard procedures, repeated prolonged contact
with high risk groups and any direct contact with
infectious individuals.
- Mantoux testing of covered employees at specific
intervals (*exception:  worker(s) with documented
positive TB skin test and documented adequate
treatment for disease or prevention).
- Recordkeeping - Positive PPD and tuberculosis
disease are recordable on the OSHA 200 logs if they
are work related.
- Work removal when an employee is found to have
current pulmonary or laryngeal TB.
- Training and education regarding the hazards and
control of TB.  This shall also include the proper
use of HEPA respirators or a higher level of
protection.
- Protocols for the transport of TB patients; the
patient shall be evaluated to determine if it is
medically feasible for the individual to do an
appropriate respirator after transport.  The windows
of the vehicle should be kept open after transport
to ventilate the vehicle and the heating and air
conditioning system set on a nonrecirculating cycle.
