Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a) The hazard of being thrown out of a raised wooden platform
attached to the lifting carriage of the Gehl Dynalift 883 Forklift
approximately 22 feet above ground level on or about 4-13-92 and
at times prior thereto at the construction site at 301 2nd Ave.
East, Polson, Mt. One feasible and acceptable means of abatement,
among others, to correct this hazard would be to follow the manu-
facture's recommendations which state's " Do not use this machine
as a personnel lift, or fit machine with any form of personnel
work platform when using the forklift".
