Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
(a) At Lakeview Care Center:  Health care workers such as but not
limited to nurses, nursing assistants, housekeeping, laundry and
maintenance employees working in bath areas, resident rooms,
laundry, or in other areas throughout the care center were
exposed to the hazard of being infected by Hepatitis B Virus (HBV)
and/or Human Immunodeficiency Virus (HIV) through possible direct
contact with blood or other body fluids.  Among other methods,
feasible and useful abatement methods for reducing this hazard
are:
(1) In the infection control policy address the follow up procedures to
be used after possible exposure to HIV or Hepatitis B Virus.  The
following is the required procedure:
a. Informing, obtaining consent and testing all source patients
for HIV and Hepatitis B Virus (HBV) infections following per-
cutaneous (needlestick or cut), mucous membrane (splash to eye,
nasal mucosa or mouth) exposure to blood or body fluids or cutane-
ous when the worker's skin is chapped, abraded, or otherwise non-
intact.
b. Clinically and serologically evaluating health care workers for
evidence of HIV infection as soon as possible following all
exposures, as listed above, in which seronegativity of the source
patient has not been confirmed.  HIV seronegative workers shall be
retested 6 weeks post-exposure and on a periodic basis thereafter
(12 weeks and 6 months after exposure).  The health care worker
shall be advised to report and seek medical evaluation of any
acute febrile illness that occurs within 12 weeks after exposure.
c. The types of follow-up procedures for employees exposed or
potentially exposed to Hepatitis B Virus depends of the immuniza-
tion status of the worker and the serologic status of the source
patient.
(2) Provide the Hepatitis B Vaccination free on charge to all employees
that may be exposed to blood or contaminated body fluids including but
not limited to nurses, nuring assistants, maintenance, housekeeping and
laundry employees.
(3) Train all employees potentially exposed to blood or contaminated
body fluids including maintenance, housekeeping, and laundry employees
on universal precautions.
