Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to employees in that
employees were exposed to the hazard of being struck by railroad
cars:
(a)Rail car unloading site  On or about December 15, 1993,
and at times prior thereto, employees accessed rail cars
while they were moving to set brakes, thereby exposing
employees to the hazard of slipping or falling and being
struck by the rail car.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD
TO CORRECT THIS HAZARD IS:
(1)Prohibit employees from placing feet on knuckles,
uncoupling lever, drawbar assembly or any drawbar
devices;
(2)Prohibit employees from getting on or off moving cars;
(3)Allow only trained employees to access stopped cars by
using car ladders.  Employee must face ladder or steps
when getting off or on cars. Employee must have secure
handhold on grab irons and must not encumber hands with
tools, grips or materials;
(4)Prohibit employees from riding cars unless the employee
has been trained, and the employee is position on the
brake platform.  In addition, employees will wear a
safety belt with side Drings with the lanyard attached
to each side and wrapped over several times over the hand
hold bar to prevent the employee from falling from the
platform; and
(5)Use traffic cones to mark stopping location of car to
communicate to the employee how far a car must travel
before the brakes must be set.

failure:
(a)Truck loading point for rolled corn and barley  On or
about December 15, 1993, and at times prior thereto, the
platform constructed of 2"x12" planks was not designed
for a 4 to 1 safety factor.
