Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to motor vehicles with safety defects: (a)On or about October 18, 1995 and at times prior thereto, 1985 Ford truck-tractor (Idaho Vehicle License # XA1293) and 1984 West semi-trailer (Idaho Vehicle License # ZA9428) had the following safety defects: (1)The left brake on axle # 4 was inoperative (Reference 49 CFR 393.48(a)); (2)The right brake on axle # 5 was adjusted to 2 1/4 inches {Reference 49 CFR 396.3(a)(1)}; NOTE: The maximum stroke at which brakes are out of adjustment for a type 30 brake chamber is 2 inches. (3)The left brake on axle # 5 was adjusted to 2 inches {Reference 49 CFR 396.3(a)(1)}; (4)The air brake supply line for axle # 4 was spliced with two hose clamps {Reference 49 CFR 393.46}; (5)The thickness for the left brake linings on axle # 5 was less than 1/8 inch {Reference 49 CFR 393.47}; NOTE: Brake linings of less than 1/4 inch are worn-out and must be replaced. (6)The right air can for axle # 2 leaks when brakes were applied {Reference 49 CFR 396.3(a)(1)}; (7)When the brakes were applied, the leaks in the air brake system exceeded the compressor's ability to replenish the air pressure, resulting in a pressure drop {Reference 49 CFR 396.3(a)(1)}; (8)The left and right turn signal lights were inoperative on the truck-tractor {Reference 49 CFR 393.19)}; (9)The left brake light was inoperative on the truck-tractor {(Reference 49 CFR 393.25(f)}; (10)The left brake light was inoperative on the semi-trailer when the running lights were on {Reference 49 CFR 393.19)}; (11)The inside tire on axle # 4 was worn-out with fabric exposed {Reference 49 CFR 393.75(a)(1)}; and (12)The outside tire on axle # 4 was worn-out with less than 2/32 inch of tread depth {Reference 49 CFR 393.75(c)}. (b)On or about October 18, 1995 and at times prior thereto, 1985 Ford truck-tractor (Idaho Vehicle License # XA157) and 1984 West semi-trailer (Idaho Vehicle License # ZA1833) had the following safety defects: (1)The left brake on axle # 2 was adjusted to 2 inches {Reference 49 CFR 396.3(a)(1)}; (2)The right brake on axle # 4 was adjusted to 2 1/4 inches {Reference 49 CFR 396.3(a)(1)}; (3)The right brake on axle # 5 was adjusted to 2 1/2 inches {Reference 49 CFR 396.3(a)(1)}; (4)The right air can for axle # 1 leaks when brakes were applied {Reference 49 CFR 396.3(a)(1)}; (5)The right air can for axle # 3 leaks when brakes were applied {Reference 49 CFR 396.3(a)(1)}; (6)The left turn signal light was inoperative on the truck-tractor {Reference 49 CFR 393.19)}; (7)The left and right brake lights were inoperative on the truck-tractor {Reference 49 CFR 393.25(f)}; (8)The inside tires from the left and right axle # 2 were rubbing on the frame {Reference 396.3(a)(1)}. Among other methods, one feasible and acceptable abatement method to correct this hazard is to maintain vehicles in accordance with the North American Uniform Vehicle Out-of-Service Criteria and the Federal Motor Carrier Safety Regulations, 49 CFR Part 393 (Parts and Accessories Necessary for Safe Operation) and Part 396 (Inspection, Repair, and Maintenance).
