Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
fire hazards:
a) Section 7.4.1 American Standards Institute A10.16-1981 safety
requirements for construction of tunnels, shafts and caissons states
diesel fuel shall not be brought into the tunnel by means of a
pipeline. Diesel fuel was brought into the tunnel shaft areas by
means of a pipe line supplying 4000 gallons of diesel fuel from an
above ground tank through the tunnel shaft areas. Dispensing the
fuel approximately fifteen (15) feet from the portal inside the
tunnel which provides intake air for employees in the tunnel, on or
about April 21, 1989.
One feasible and acceptable means of abatement, among others, would be
to store the supply of diesel fuel underground to no more than that
required for one day's use in approved tanks.
