Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the recognized hazard of falls. a) The walkway used by employees did not provide safe access from the marine railway dockside to the vessel Fadalgo in that two 2-inch by 6-inch boards were utilized as a gangway. This condition exposed employees to the hazard of falls which could result in broken bones or death. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is the installation of a safely secured gangway, of not less than 20 inches walking surfaces, adequate strength, and equipped with a standard handrail and midrail.
