SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO BLOODBORNE PATHOGENS: A) EMPLOYEES WERE EXPOSED TO BLOODBORNE PATHOGENS (SUCH AS HEPATITIS B VIRUS AND HUMAN IMMUNODEFICIENCY VIRUS) BY INJECTION THROUGH IMPROPER PRACTICES AND/OR ENGINEERING CONTROLS. FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD, AMONG OTHERS, ARE: 1) THE USE OF MECHANICAL RECAPPING DEVICES TO ELIMINATE EMPLOYEES EXPOSURE TO ACCIDENTAL NEEDLE STICKS AND EXPOSURE TO BLOODBORNE DISEASES. 2) THE USE OF APPROPRIATE SHARPS CONTAINERS FOR THE DISPOSAL OF INSULIN SYRINGES AND OTHER SHARPS WHICH WOULD ELIMINATE RECAPPING AND/OR CLIPPING NEEDLES AND EXPOSURE TO BLOODBORNE DISEASES THROUGH NEEDLE STICK INJURIES.
