SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO MOTOR VEHICLES NOT MAINTAINED IN SAFE OPERATING CONDITIONS AND HAD EVIDENCE OF STRUCTURAL DEFECTS THAT COULD CAUSE FAILURE: A) HIGHWAY 55, HORSESHOE BEND, IDAHO - THE VALVE FOR AXLE 2 (BOOSTER) ON THE KENWORTH TRUCK, 9307, HAD AN AIR LEAK RENDERING IT INCAPABLE OF RAISING THE AXLE (REFERENCE 49 CFR 393.46). B) HIGHWAY 55, HORSESHOE BEND, IDAHO - TWO OUT OF THE SIX FIFTH WHEEL MOUNTING PLATE BOLTS ON THE KENWORTH TRUCK, 9307, WERE LOOSE (REFERENCE 49 CFR 393.70). C) HIGHWAY 55, HORSESHOE BEND, IDAHO - THERE WAS A STRESS CRACK IN THE FRONT LEFT SIDE OF THE FRUEHAUF TRAILER, T6, BELLY DUMP (REFERENCE 49 CFR 393.201). D) HIGHWAY 55, HORSESHOE BEND, IDAHO - THER WAS A FRAME CRACK IN A WELD ON THE RIGHT SIDE OF THE FRUEHAUF TRIALER, T6, ABOVE AXLE 5 (REFERENCE 49 CFR 393.201).
