Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Establishment: On 5/9/91, health care workers (Dental Assistant, Office Manager) were exposed to the hazard of being infected by HBV and/or HIV through possible direct contact with blood or other body fluids and training had not been provided to them. This training and education should contain the following elements: 1. A general explanation of the epidemiology and symptoms of HBV and HIV. 2. An explanation of the modes of transmission of HBV and HIV. 3. An explanation of the employer's infection control program (ICP). 4. An explanation of the use and limitations of methods of control that may prevent or reduce exposure including universal precautions, engineering controls, work practices, and personal protective equipment. 5. An explanation of the basis for the selection of personal protective equipment. 6. Information of the HBV vaccine, including efficacy, safety, and the benefits of being vaccinated. 7. An explanation of the procedures to follow if an exposure incident occurs, method of reporting the incidents, and the medical follow-up that will be made available. 8. An explanation of the signs, labels, tags, and/or color coding used to denote biohazards.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Establishment: On 5/9/91, health care workers (Dental Assistant, Office Manager) were exposed to the hazard of being infected by HBV and/or HIV through possible direct contact with blood or other body fluids and the employer failed to offer employees the Hepatitis B Virus vaccination. One feasible and useful abatement method for reducing this hazard, among others would be to offer the Hepatitis B Virus vaccination to his employees at no cost to them.
