Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Establishment: Health care workers (Emergency First Aid Providers) were exposed to the hazard of being infected by HBV and/or HIV through possible direct contact with blood or other body fluids. NOTE: Feasible and useful abatement methods for reducting this hazard, among others, are: Item 1a (continued) Education on precautionary measures, spidemiology, modes of transmission and prevention of HIV/HBV. Training and education shall include location and proper use of personal protective equipment, proper work practices, and understand the concept of "Universal Precautions".

NOTE: Feasible and useful abatement methods for reducing this hazard, among other are: Item 1c (continued) Development and implementation of medical follow-up procedures following potential exposure to HBV/HIV. Such procedures consist of, but not limited to: 1. Source patient notification and consent requested for HIV and HBV testing. 2. If consent denied, exposed employee shall be clinically evaluated, tested, and counseled. 3. A recommended source of information is the CDC Immunization Practices Advisory Committee publication for HBV post exposure prophylaxis in the June 7, 1985 Morbidity and Mortality Weekly Report.
