The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death or serious physical harm to the employee in that:
Employees in (a)Center 2, (b) Center 3, (c) Bronchoscopy Room, (d)
HIV Counseling/Testing Department, (e) Outpatient Infectious
Disease were exposed to the hazard of being infected by
tuberculosis through repeated prolonged indoor contact with
patients who may be infected with tuberculosis in that:
AFB (Acid Fast Bacilli) isolation rooms maintained under negative
pressure were not available when such patients were undergoing
bronchoscopy, sputum induction, suction procedures and other high
risk procedures.
Violation observed on or about 6/23/93
Feasible and acceptable abatement methods for correcting this
hazard, as recommended by the Center for Disease Control, include:
AFB isolation rooms, under negative pressure, exhausted to the
outside, shall be provided when patients with, or suspected to
have, active tuberculosis are present in:
(a)  Center 2 respiratory isolation floor;
(b)  Center 3 respiratory isolation floor;
(c)  Bronchoscopy Room used for bronchoscopy and other high risk
procedures;
(d)  HIV Counseling/Testing Department;
(e)  Outpatient Infectious

The employer did not furnish employment and a place of employment

to cause death or serious physical harm in that employees were
exposed to: the hazard of being infected with Mycobacterium
Tuberculosis through repeated and prolonged indoor contact with
active or suspected TB patients:
a)  HIV Counseling/Testing Department;
HIV counselors who were exposed to the hazard of being infected
with Mycobacterium Tuberculosis through contact with suspected
active TB outpatients (HIV positive) were not provided with Mantoux
PPD skin test as recommended by the CDC guidelines.
Violation observed on or about 6/23/93
Among other methods, some feasible and acceptable abatement methods
to correct this hazard as recommended by the CDC guidelines are:
1.   Provide workers with frequent exposure to patients with TB or
are involved with high hazard procedures the Mantoux PPD test
at least every six months.
2.   Provide training for employees in the mode of transmission of
TB.
