Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Clairton, PA., Saint Clair Cemetery, grave site. The sides of the trench in hard or compact soil, including embankments, were not shored or otherwise supported when the trnch was 5 feet 8 inches in depth and 9 feet in length. Sides of the trench were caving in on wet soil.
