Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) G.P.I.A. New Midfield Terminal, Utility Service Tunnel; Employees were using an ENERPAC CP-501 cable puller, a machine designed to pull wire through conduit, to pull 10 inch inside diameter pipe which weighed approximately 6,700 pounds. The employer used a rope on this machine to pull pipe which was prohibited by the manufacturer. The manufacturer warns: Warning! If a rope breaks under tension, it can recoil with lethal force!

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) G.P.I.A. New Midfield Terminal, Utility Service Tunnel; A fastening chain, other than the one supplied by the vendor of the ENERPAC CP-501 power puller for securing the machine was used to secure the machine to a 10 inch I.D. pipe was used resulting in the machine coming loose and resulting in the death of the operator.

The employee was permitted to be in an area (trajectory zone) where he could be hit by the breaking rope or flying machine. The alleged violations above have been grouped because they involve similar or related hazards that may increase the potential for injury resulting from an accident. resulting from an accident.
