Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) OTR Shop; The hoist in the OTR Shop was not kept in good repair in that: (1) The rated load was not permanently marked on the hoist, (2) The supporting structure did not have a load rating, (3) Load testing was not done with a written report confirming the load rating, (4) The wire rope was twisted and jammed the hoist, (5) Frequent and periodic inspections were not conducted with written, dated, and signed reports/records, (6) A preventative maintenance program was not developed or implemented, (7) Wire rope and hook inspections were not conducted with written, dated and signed reports/records. Among other methods, one feasible and acceptable abatement method to correc t this hazard is to develop a preventative maintenance procedure in accordance with ANSI B30.16 in order to ensure a safe and proper functioning hoist.
