Section 5(A)(1)
of the Occupational Safety and Health Act of 1970:  The employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to caught between:
Hog Farm - Brownfield, Tx:  An employee was required to use a
International Harvester #1466
tractor and feed wagon to haul and fill hog bins with feed.  The tractor
did not have adequate
brakes to hold the tractor while parked in a downhill position. The
employee was required to
wedge a three foot by one-half inch diameter PVC pipe between the brake
and the interior of
the cab. The pipe jarred loose, causing the tractor to roll unattended
down hill.  This condition
exposed the employee to being struck by the equipment as it did occur on
or about December
6, 1993. The employer could have protected his employee by means such as;
establishing and
implementing a preventive maintenance program on all farm vehicles used
by all employees at
the farm.  This shall include, but is not limited to, daily review of
truck hours and documented
monthly visual inspections of all farm vehicles.
