Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to empoloyees in that employees were exposed to increased risk of contracting Hepatitis B or Acquired Immunodeficiency Syndrome (AIDS) due to the handling of articles, contaminatedwith blood and body fluids: Feasible and useful abatement methods for reducing this hazard, among others are: 1) Ensure that all new employees such as phlebotomist receive training and education on precautionary measures, epidemiology, modes of transmission, risk to the fetus, pevention of HBV/HIV, proper work practices, the concept of universal precautions, handling of infectious waste and procedures to be followed in the event of exposure to body fluids. 2) Ensure that follow-up procedures are implemented after possible exposure, such as when nurses are cut with broken capillary tubes, that include HBV/HIV testing of the source and employee (after obtaining proper consent) and other appropriate procedures as outlined by the CDC.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of entering and working in confined spaces which may contain atmospheres that are hazardous to life and health because of the presence of flammable, explosive, or toxic contaminants or because of deficiency or excess of. Feasible and useful methods to correct this hazard include, but are not limited to: 1) Provide continous ventilation to all confined spaces prior to entry and during work operations such as during boiler entry.
