Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees,in that,employees were exposed to serious crushing and falling hazards on the second floor from an inclined reciprocating conveyor. A feasible and useful method to correct the hazards, among other methods is to provide enclosed perimeter guarding around the entire landing, equip the access way with an electrically and mechanically interlocked gate to prevent it from being opened until the platform has reached that level, limiting the travel of the platform on the second floor and enclosing the floor openings to conform with the size of the platform. (a) Second Floor - Building Area: The landing for the inclined reciprocating conveyor was not equipped with adequate perimeter guarding and electrically and mechanically interlocked gates to protect employees from the crushing and falling hazards. Also the floor opening was wider than the platform exposing employees to fall hazards when loading or unloading operations were conducted.
