Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to serious crushing injuries on the first floor and basement levels and serious fall hazards from the first floor where the platform is located at the basement level. A feasible and useful method to correct the hazards, among other methods is to provide perimeter guarding around the entire inclined reciprocating conveyor and equip both landings with electrically and mechanically interlocked gates to prevent them from being openend until the platform has reached the level: a) Warehouse: The Giant inclined reciprocating conveyor was not equipped with perimeter guarding and interlocked gates exposing employees to serious crushing injuries and fall hazards.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to serious crushing injuries and fall hazards while riding on the inclined reciprocating conveyor platform while transporting materials between the first floor and basement. A feasible and useful method to correct the hazards among others is to prohibit employees from riding on the inclined reciprocating conveyor platform: a) Warehouse: Employees were allowed to ride on the platform of the Giant inclined conveyor platform while transporting materials between the first floor and basement levels exposing them to serious fall hazards and crushing injuries.
