Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees,in that,employees working under a load suspended by a crane: (a) Jobsite; CP282 at the outflow tunnel: Employees working at the shaft bottom while loads were being hoisted in and out of this shaft over the heads of the employees. If a load was lost by the crane these workers would be seriously injured or killed. The shaft is 180' in depth and 32' in diameter. Among other feasible methods, one acceptable method to correct this hazard is to implement a system which ensures that employees stand against the shaft wall while loads are moved up and down the shaft. The method must include training, a warning system and communication.
