General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of working under a load suspended by a crane: (a) Outfall Shaft, where the loader operator continued to muck out the shaft bottom while the muck buckets were raised and lowered over his head, exposing the operator to the threat of death by crushing in the event that a load was lost by the crane. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a system which ensures that employees stand against the shaft wall while loads are moving up and down the shaft. This method would include adequate training, effective communication, and a warning system. The use of a lean-to or other protective structure would further protect employees working the shaft bottom.
