Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of asphyxiation by entering leaching basins. The employer did not establish safe procedures to protect employees working in leaching basins or any confined space from recognized hazard of being overcome by toxic gases or oxygen deficient atmospheres. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the confined space entry procedures as described in NIOSH criteria document pub. 80-106, working in confined spaces, which include such components as a permit system, standby personnel, provisions for rescue equipment, continuous ventilation, and appropriate respiratory equipment.
