Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to working conditions and recognized hazards of possible serious injury or death could result from the fall of employees from a single point suspension scaffolds, which were not properly installed during painting and sandblasting operations. (a) Jobsite; Evaporator storage tank: Employees were exposed to possible serious injury and fall hazards while performing their work duties from single point suspension scaffolds, where the erection and installation did not conform to the manufacturers installation and operational procedures. Wire rope slings were used to fasten the tank top roller systems, the wire rope clips were not installed with the saddle on the live end, the tank top rollers had been installed and allowed to roll around the circumference of the tank, while located on top of the top rail of the guardrail system, employees had their lifelines attached to bent reinforcing rod and hung over the guardrail at the top of the tank and not securly attached to the tank structure. Among other methods, one feasible and acceptable abatement method to correct the hazards would be to install all scaffolding, suspension methods, safety equipment and other similar procedures in accordance with the manufacturer's installation and operational procedures and recommendations.
