Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the hazard of falls, from the heights of 150 feet, as a result of the man basket becoming detached from its support: a) Atop of the primary tower an articulating/rotating, boom supported, manbasket, had been used with the man basket attachment in need of repair or replacement in that, the fiberglass basket was cracked in and/or around the area of the support attachment assembly, on or about April 19, 1990. Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the entire platform (Man Basket).
