Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: EMPLOYEES WERE EXPOSED TO THE HAZARD OF BEING THROWN FROM AND CRUSHED BY A MOTORIZED TRACTOR WHEN IT DROVE INTO AN EXCAVATION AT SITE NUMBER 414-37 OF THE TENNACO GAS PIPELINE ON SEPTEMBER 20, 1990. THERE WAS AN EMPLOYEE RIDING ON THE WINCH AREA OF THE TRACTOR. A FEASIBLE METHOD TO CORRECT THIS HAZARD IS TO NOT ALLOW EMPLOYEES TO RIDE ON THE MACHINES; OTHER THAN THE OPERATOR AND ALSO TO ENSURE AND ENFORCE THIS WORK RULE.
