Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: A) THE HAZARD OF BEING STRUCK BY FALLING OBJECTS. THE CONDITION CREATING THE HAZARD OCCURS WHEN A TRUCK DELIVERS AGGREGATE TO PLANT #4. AT THE HOPPER AREA A POTENTIAL EXISTS THAT THE TRUCK COULD BACK UP OVER THE EDGE OF THE BUILDING OR DUMP THE PRODUCT ALSO. AMONG OTHER METHODS, ONE FEASIBLE WAY TO ABATE THE HAZARD WOULD BE TO PROVIDE WHEEL STOPS AND A SCREEN BARRIER.
