Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

free from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in that, employees in the soil sort are a
are exposed to the hazard of being infected with Hepatitis B or other blood
borne diseases through possible direct contact with blood or other body
fluids, by needlestick injuries, or by injuries caused by other sharps.   A
feasible and useful abatement method for reducing these hazard(s), among
others, is:
(a) EMPLOYERS SHALL ENSURE THAT ALL EMPLOYEE(S) IN THE SOIL SORT AREA
PARTICIPATE IN A TRAINING PROGRAM WHICH SHALL INCLUDE THE FOLLOWING ELEMENT S
1. TRAINING SHALL BE PROVIDED AT THE TIME OF INITIAL EMPLOYMENT AND AT LEA S
ANNUALLY THEREAFTER.
2. MATERIAL APPROPRIATE IN CONTENT AND VOCABULARY TO EDUCATIONAL LEVEL,
LITERACY, AND LANGUAGE BACKGROUND OF EMPLOYEES SHALL BE USED.
3. THE TRAINING PROGRAM SHALL INCLUDE AN EXPLANATION OF THE CONTENTS OF TH I
PROGRAM.
4. THE TRAINING PROGRAM SHALL CONTAIN A GENERAL EXPLANATION OF THE EPIDEMI O
AND SYMPTOMS OF BLOODBORNE DISEASES.
5. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE MODES OF
TRANSMISSION OF BLOODBORNE PATHOGENS.
6. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE EMPLOYER'S
INFECTION CONTROL PROGRAM.
7. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE APPROPRIATE ME T
FOR RECOGNIZING TASKS AND OTHER ACTIVITIES THAT MAY INVOLVE EXPOSURE TO BLO O
AND OTHER POTENTIALLY INFECTIOUS MATERIALS.
8. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE USE AND LIMITA T
OF PRACTICES THAT WILL PREVENT OR REDUCE EXPOSURE INCLUDING APPROPRIATE
ENGINEERING CONTROLS, WORK PRACTICES, AND PERSONAL PRO-TECTIVE EQUIPMENT.
9. THE TRAINING PROGRAM SHALL CONTAIN INFORMATION ON THE TYPES, PROPER USE ,
LOCATION, REMOVAL, HANDLING, DECONTAMINATION AND/OR DISPOSAL OR PERSONAL
PROTECTIVE EQUIPMENT.
10. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE BASIS FOR
SELECTION OF PERSONAL PROTECTIVE EQUIPMENT.
11. THE TRAINING PROGRAM SHALL CONTAIN INFORMATION ON THE HEPATITIS B VACC I
INCLUDING INFORMATION ON ITS EFFICACY, SAFETY, AND THE BENEFITS OF BEING
VACCINATED.
12. THE TRAINING PROGRAM SHALL CONTAIN INFORMATION ON THE APPROPRIATE ACTI O
TO TAKE AND PERSONS TO CONTACT IN AN EMERGENCY.
13. THE TRAINING PROGRAM SHALL CONTAIN AN EXPLANATION OF THE PROCEDURE TO
FOLLOW IF AN EXPOSURE INCIDENT OCCURS, INCLUDING THE METHOD OF REPORTING TH E
