Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by and/or being crushed by a bus being serviced: (a) THE LIFT CONTROL MACHANISM(S) ON TWO WEAVER ELECTRIC-OIL OPERATED EC-10 6 FULLY HYDRAULIC LIFT(S) (AXLE ENGAGING-TYPE) DID NOT RETURN TO THE NEUTRAL OR "OFF" POSITION WHEN RELEASED. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORREC T THIS HAZARD, IS TO PROVIDE POSITIVE EMPLOYEE TRAINING AND ENFORCEMENT BY MANAGEMENT ON THE NECESSITY OF MAINTAINING THE LIFT CONTROL MACHINISM(S) (DEAD-MAN CONTROLS) FULLY OPERATIONAL. (b) TWO WEAVER ELECTRIC-OIL OPERATED EC-106 FULLY HYDRAULIC LIFT(S) (AXLE ENGAGING-TYPE) WERE NOT EQUIPPED WITH AN AUTOMATIC MECHANICAL DEVICE TO HOL D THE LIFT(S) IN THE FULLY EXTENDED POSITION. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORREC T THIS HAZARD, IS TO PROVIDE LOCKING DEVICE(S) OR SAFETY LEG(S) WHICH MUST BE UTILIZED TO HOLD THE LIFT IN THE FULLY EX-TENDED POSITION. (c) TWO WEAVER ELECTRIC-OIL OPERATED EC-106 FULLY HYDRAULIC LIFT(S) (AXLE ENGAGING-TYPE) WERE NOT PERMANENTLY MARKED TO SHOW THE MANU-FACTURER'S NAME , RATED LOAD CAPACITY, MODEL, AND SERIAL NUMBER. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORREC T THIS HAZARD, IS TO OBTAIN THE TAG OR LABEL FROM THE MANUFACTURER OR TO FABRICATE A LABEL WITH THE APPROPRIATE INFORMATION AND PERMANENTLY AFFIX IT TO EACH HYDRAULIC LIFT. (d) NO PERIODIC INSPECTION PROCEDURE ESTABLISHED AS RECOMMENDED BY THE MANUFACTURER TO ENSURE THE SAFE OPERATION OF THE TWO WEAVER ELECTRIC-OIL FULLY HYDRAULIC LIFT(S) (AXLE ENGAGING-TYPE). AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORREC T THIS HAZARD, IS TO ESTABLISH A FORMAL PERIODIC PROCEDURE WHICH IS STRICTLY ENFORCED IN ORDER TO ENSURE THE SAFE OPERATION OF THE LIFT(S).
